Migration Amendment Regulations 2022 – Occupation Nomination and Skills Assessment for 485 Visas

Migration Regulations are amended by the Amendment Regulations for filling critical skills and labour gaps. It is usually done by temporarily removing certain applicants’ requirements from the Visa Subclass 485. This is mainly for those in the Graduate Work stream.

As of now, all applicants of the Graduate Work stream are required to:

  • Nominate a significant occupation on the Medium and Long-term Strategic Skills List;
  • Possess a valid degree of trade or diploma qualification which is closely related to the particular occupation; and
  • Be essentially assessed by any relevant assessing authority for possessing the appropriate skills for that particular occupation.

Terminating all these requirements will encourage a more significant number of international vocational education and training (VET) graduates. They will be motivated to reside and work in Australia for a significantly extended period. Besides, the visa stream will also open up to a considerably broader range of trade and diploma qualifications graduates. However, it is only for those who aren’t closely related to the occupations on the skilled occupation list.

All applications lodged during the 2022-23 financial year will have these requirements withdrawn. There are chances for this concession duration to be extended by the legislative instrument. Nevertheless, the present labour shortages will not be ameliorated after that period.
