New PR Pathway For TSS (Short Term Stream) and Temporary Work Visa Holders

Skilled migrant workers who wish to stay in Australia during the pandemic will have increased opportunities to obtain permanent residence from July 1, 2022. The arrangements are particularly for Temporary Work (Skilled) subclass 457 and Temporary Skill Shortage subclass 482 visa holders.

What About TSS Visa Holders in the Short-Term Stream?

TSS visa holders in the short-term stream can try becoming permanent residents through the Temporary Residence Transition under the Employer Nomination Scheme subclass 186 visa.
All TSS visa holders can be eligible for it through the following:

  • Resided in Australia for a minimum of one year from February 1, 2020, to December 14, 2021
  • Satisfy various nomination and visa requirements related to the TRT stream of the ENS visa

Applicants should know that the pathway will be offered for two years from July 1, 2022.
The arrangements are also valid for visa subclass 457 holders whose occupations are mentioned on the Short-term Skilled Occupation List. It ensures that subclass 457 holders can apply for the TRT stream without applying for a TSS visa.

Transitional arrangements for visa subclass 457 holders trying to obtain permanent residence via this method were implemented when the TSS visa came as a replacement for the TSS visa. The transitional arrangements were supposed to end on March 18, 2022. However, it will continue to be available for review within two years.

What About Legacy Temporary Work (Skilled) Visa Holders Who Don’t Meet Age Requirements?

Legacy visa subclass 457 holders have access to age exemption while applying through the TRT stream of the ENS subclass 186 visa.

However, they need to meet specific eligibility requirements for the age exemption. The requirements are as follows:

  • Applicants need to have held the visa subclass 457 on or after April 18, 2017.
  • Applicants need to have resided in Australia for a minimum of one year. The residence period of one year should be between February 1, 2020, and December 14, 2021.
  • Applicants need to satisfy every visa and nomination requirement to apply through the TRT stream of the ENS visa.
  • Applicants should remember that the age exemptions can be accessed for two years, starting from July 1, 2022.

What About TSS Visa Subclass 482 Holders Who Can’t Apply for Stream of a TSS Visa?

TSS visa holders who stayed in Australia during the pandemic can apply for a third stream of short-term TSS visas. But they need to meet the following eligibility requirements:

  • Applicants shouldn’t have to hold more than two streams of TSS visas.
  • Applicants should have resided in Australia for one year while holding the TSS visa. The period of residence should be between February 1, 2020 and December 14, 2021.
  • Applicants should satisfy all requirements of the TSS short-term visa stream.

Applicants should know that they can apply for a TSS visa only if they hold a bridging visa while filling up the application. The third stream of the TSS visa will be accessible from July 1, 2022, and will last for a year.
